Divine Love Home Care LLC is committed to protecting the privacy and confidentiality of your protected health information (PHI). This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
Our Commitment to Your Privacy
Divine Love Home Care Services is certified by Indiana Medicare OMPP to provide Home and Community Based Services (HCBS) waiver services. As such, we are required by law to maintain the privacy of your PHI and to provide you with this notice of our legal duties and privacy practices with respect to your PHI. We are obligated to follow the terms of the notice currently in effect.
How We May Use and Disclose Your PHI
We may use and disclose your PHI for the following purposes without your prior authorization:
Treatment: We may use and disclose your PHI to provide, coordinate, and manage your health care and related services. This includes sharing information with other healthcare providers involved in your care, such as your physician, specialists, therapists, and pharmacists. For example, we may share information with your doctor to ensure continuity of care or with a physical therapist to coordinate your therapy sessions.
Payment: We may use and disclose your PHI to bill and collect payment for the services we provide to you. This may include disclosing information to Indiana Medicare OMPP, your insurance company, or other third-party payers. For example, we may submit your information to Indiana Medicare OMPP to receive payment for your HCBS waiver services.
Healthcare Operations: We may use and disclose your PHI for our internal operations necessary to run Divine Love Home Care Services and ensure quality care. This may include activities such as quality assessment and improvement, professional review activities, training of staff, and business management. For example, we may use your health information to review the quality of our services.
Required by Law: We will disclose PHI when required to do so by federal, state, or local law.
Public Health Activities: We may disclose your PHI for public health activities, such as preventing or controlling disease, injury, or disability; reporting births and deaths; reporting child abuse or neglect; and notifying people of recalls of products they may be using.
Victims of Abuse, Neglect, or Domestic Violence: We may disclose your PHI to a government authority, if we reasonably believe you are a victim of abuse, neglect, or domestic violence. We will only make this disclosure when required or authorized by law, or with your agreement.
Health Oversight Activities: We may disclose PHI to a health oversight agency for activities authorized by law, such as audits, investigations, inspections, and licensure.
Judicial and Administrative Proceedings: We may disclose PHI in the course of any judicial or administrative proceeding, in response to a court order or administrative tribunal, or in response to a subpoena, discovery request, or other lawful process.
Law Enforcement: We may disclose PHI to law enforcement officials for certain purposes, such as in response to a warrant, subpoena, or court order; to identify or locate a suspect, fugitive, material witness, or missing person; or in emergency circumstances.
Coroners, Medical Examiners, and Funeral Directors: We may disclose PHI to coroners or medical examiners for identification purposes, determining cause of death, or other duties authorized by law. We may also disclose PHI to funeral directors consistent with applicable law.
Organ and Tissue Donation: We may disclose PHI to organ procurement organizations for organ, eye, or tissue donation and transplantation.
Research: We may use and disclose your PHI for research purposes under certain limited circumstances, with your authorization, or when an Institutional Review Board (IRB) or Privacy Board has waived the authorization requirement.
Serious Threat to Health or Safety: We may use and disclose your PHI when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.
Workers' Compensation: We may disclose your PHI as authorized by and to the extent necessary to comply with laws relating to workers' compensation or other similar programs.
Your Rights Regarding Your PHI
You have the following rights regarding your PHI:
Right to Inspect and Copy: You have the right to inspect and obtain a copy of your PHI that we maintain, which may include your medical records and billing records. We may charge a reasonable, cost-based fee for the copies.
Right to Amend: If you believe that the PHI we have about you is incorrect or incomplete, you may ask us to amend the information. We may deny your request if the information is accurate and complete.
Right to an Accounting of Disclosures: You have the right to request an accounting of certain disclosures of your PHI made by us.
Right to Request Restrictions: You have the right to request a restriction or limitation on the PHI we use or disclose about you for treatment, payment, or healthcare operations. We are not required to agree to your request, but if we do, we will comply with that restriction unless the information is needed for emergency treatment.
Right to Request Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you can ask that we only contact you at work or by mail.
Right to a Paper Copy of This Notice: You have the right to a paper copy of this notice, even if you have agreed to receive this notice electronically. You may ask for a copy of this notice at any time.
Changes to This Notice
We reserve the right to change this notice at any time. The revised notice will be effective for all PHI that we maintain. We will post a copy of the current notice at our facility and on our website.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with Divine Love Home Care Services or with the Secretary of the Department of Health and Human Services. You will not be penalized for filing a complaint.
